Fandiem Auction Rules & Conditions of Sale

These Auction Rules & Conditions of Sale (“Terms”) govern all auctions conducted on Fandiem.com (“Fandiem”). By registering, placing a bid, or otherwise participating, you agree to be legally bound by these Terms. If you do not agree, do not participate in the auction.

1. Conditions of Sale

• All bids are final and binding. Once placed and confirmed, a bid constitutes a legally enforceable offer to purchase the listed item or experience.
  

• The highest valid bid at the close of the auction will be deemed the winning bid (“Hammer Price”), subject to these Terms.
  

• Fandiem reserves the right to: (i) withdraw or cancel any listing at any time before, during, or after the auction, (ii) reject or void any bid, and (iii) modify or terminate auctions at its sole discretion.
  

• All items and experiences are offered “AS IS”, with no warranties or guarantees—express or implied.
  
  

2. Item Condition & Return Policy

• Items may be new, used, or pre-owned. See individual listings for specific details.
  

• All sales are final. No returns, refunds, or exchanges will be permitted under any circumstances.
  

• No warranties—express or implied—are provided with any items or experiences.
  

• The item does not include anything beyond what is listed with the item on the auction page.

3. Charitable Disclosure

• Auctions are conducted in support of charitable causes. Proceeds may benefit one or more 501(c)(3) nonprofit organizations as designated in each listing.
  

• Fandiem may retain a portion of proceeds to cover costs associated with promoting, administering, and fulfilling auction items.
  

• Please consult your tax advisor regarding any deductibility of winning bids.

4. Bidding & Proxy Bidding

• In order to place bid a debit/credit card must be held on file.

• Bidders may place incremental bids or utilize “Max Bids” (if available) to set the maximum amount they are willing to pay. The system will automatically bid on your behalf in the smallest allowed increment until your Max Bid is reached.
  

• In the event of identical bids, the earliest received bid will be considered the leading bid.
  

• Bidders are responsible for ensuring the accuracy of their bids before submission.
  
  

5. Extended Bidding (“Anti-Sniping”)

• To maintain fairness, if a bid is placed within the final 10 minutes of an auction, the closing time will automatically extend by an additional 10 minutes from the time of the last bid.
  

• This process may repeat until no further bids are placed within the final 10-minute period.
  
  

6. Payment & Buyer’s Premium

• Winning bids will be automatically charged to the payment method on file. 

• A 10% Buyer’s Premium applies to all winning bids and will be charged in addition to the hammer price.

• If your payment is declined, you will have 72 hours to submit payment through one of the accepted methods listed below:

Accepted Payment Methods:

Domestic Bank Wires – Processed immediately

ACH Transfers – 5 to 7 business days

International Bank Wires* – 2 to 5 business days

Debit/Credit Cards – Visa, Mastercard, Discover, American Express (processed immediately)

• Failure to pay within 72 hours will result in a non-refundable 10% charge of the winning bid and forfeiture of the auction item, which may then be awarded to the next highest bidder.**Additional processing time and fees may apply for international wires. 7. Title Transfer

 

 

 

• Title and ownership of any item will not transfer to the winning bidder until Fandiem has received full payment, including any Buyer’s Premium, taxes, shipping, and handling charges.
  

• Fandiem may withhold delivery of items until payment has cleared.
  
  

8. Shipping & Fulfillment

• Shipping costs and delivery timelines vary by item and will be coordinated with the winner after the auction closes.
  

• Winners may be subject to additional shipping charges based on location, item dimensions, or delivery method.
  

• Certain experiences or items may require coordination with third-party vendors or artist representatives, which may affect delivery timelines.
  

• Winners are responsible for any applicable customs duties, import taxes, or related charges for international deliveries.
  
  

9. Refunds

• All sales are final. Refunds will only be considered if the seller fails to deliver the item or experience as described within 90 days of payment and after reasonable efforts to remedy the situation.
  

• Refunds will not be granted for buyer’s remorse, misunderstanding of terms, or failure to schedule/redemption by the winner.
  
  

10. Participation in Experiences

• Participation in experiences (e.g., meet-and-greets, travel, events) is at your own risk and may require execution of waivers or compliance with additional third-party terms.
  

• Experiences are subject to artist availability, scheduling changes, travel restrictions, and other factors beyond Fandiem’s control.
  

• In the event an experience cannot occur as described due to circumstances beyond Fandiem’s control, Fandiem will make reasonable efforts to offer an alternative but cannot guarantee replacement or refund.
  
  

11. Dispute Resolution

• In the event of a dispute regarding the winning bid or auction process, Fandiem’s records will be final and binding.
  

• Fandiem reserves the right to re-offer or re-list any item in dispute.
  
  

12. Minimum Age Requirement

• Participants must be 18 years or older, or have the express consent of a parent or legal guardian, to register and place bids.
